Changes to Onshore Student Visa Applications – Effective 1 January 2025

The Department of Home Affairs has announced new requirements for onshore Student visa applications. These changes take effect from 1 January 2025 and are designed to strengthen the commitment of international students to their intended course of study. Here’s what you need to know:

Key Changes

  1. Confirmation of Enrolment (CoE) Required:

    • Onshore applicants must include a Confirmation of Enrolment (CoE) at the time of submitting their Student visa application.
    • Applications lodged with only a Letter of Offer after 1 January 2025 will be invalid.
  2. Impact of Invalid Applications:

    • Visa decision-makers cannot assess invalid applications.
    • Associated Bridging visas will not be granted if the substantive visa application is invalid.
  3. Alignment with Offshore Applications:

    • The new rule aligns onshore and offshore Student visa application requirements.
    • The CoE requirement demonstrates a stronger commitment to studying in Australia, providing certainty for the international education sector.
  4. Exemptions:

    • No changes apply to alternative forms of evidence for:
      • Foreign Affairs
      • Defence
      • Secondary exchange students

Implications for Students

  • Current Applications:

    • Applications lodged before 1 January 2025 using only a Letter of Offer will not be affected.
  • Maintaining Lawful Status:

    • Onshore applicants must ensure they maintain lawful status.
    • Students unable to obtain a CoE before their current visa expires should:
      • Depart Australia.
      • Explore other visa options.

Restrictions on Visa Hopping

  • Certain visa holders may face restrictions on applying for a Student visa while in Australia. For more information, refer to the article on Ending ‘visa hopping’ in the migration system.

Recommendations for Students

  1. Prepare Early:

    • Obtain your Confirmation of Enrolment (CoE) before lodging your Student visa application.
  2. Check Visa Status:

    • Ensure your visa remains valid while you transition to a Student visa.
  3. Seek Guidance:

    • Consult with education providers or migration agents to avoid complications.
